摘要：勞動(dòng)安全是生產(chǎn)經(jīng)營(yíng)活動(dòng)中的永恒主題。勞動(dòng)安全問(wèn)題是經(jīng)濟(jì)建設(shè)中必然會(huì)遇到，也必須妥善解決的問(wèn)題。盡管我國(guó)黨和國(guó)家高度重視勞動(dòng)安全問(wèn)題，并為此采取了一系列行政的、經(jīng)濟(jì)的和法律的措施，也確實(shí)取得了較好的效果。但從總體上講，勞動(dòng)安全形勢(shì)十分嚴(yán)峻，重大生產(chǎn)安全事故時(shí)有發(fā)生，嚴(yán)重威脅和影響著勞動(dòng)者的生命安全與身體健康，也嚴(yán)重影響著經(jīng)濟(jì)建設(shè)與社會(huì)穩(wěn)定。為妥善地解決這一問(wèn)題，本文進(jìn)行了積極有益的探索，認(rèn)為勞動(dòng)安全形勢(shì)嚴(yán)峻的主要原因是勞動(dòng)安全問(wèn)題在立法上存在著空白和矛盾，在執(zhí)法上存在著嚴(yán)重不足，尤其是一些生產(chǎn)經(jīng)營(yíng)單位的負(fù)責(zé)人或業(yè)主不重視勞動(dòng)安全，不認(rèn)真落實(shí)安全生產(chǎn)責(zé)任制，而勞動(dòng)者又缺乏安全意識(shí)與安全技能。進(jìn)而提出了應(yīng)對(duì)措施，即要按照依法治國(guó)方略，建立起一套完整的勞動(dòng)安全方面的法律體系，并要強(qiáng)化這些法律規(guī)范的實(shí)施，使勞動(dòng)安全問(wèn)題真正得到落實(shí)，從而達(dá)到勞動(dòng)安全形勢(shì)的根本好轉(zhuǎn)。

Abstract:Laborsafetyistheeternalthemeinthemanufacturingandmanagingfields.Theissueoflaborsafetycannotbeavoidedinthedevelopmentofeconomy,soitshouldbesolvedproperly.AlthoughthePartyandthegovernmenthaveplacedhighimportanceontheissue,adoptedaseriesofadministrative,economicandlegalmeasuresandachievedsomecomparativelygoodeffect,thesituationremainssevereasawhole.Bigaccidentsduringproducinghappenoccasionally,whichnotonlystronglythreatensandaffectsthesecurityandhealthoftheworkers,butalsoharmstheeconomicdevelopmentandsocialstability.Inordertosolvetheproblemproperly,thethesisiswrittenonthebasisofavigorousandbeneficialexploration.Itisputforwardinthethesisthatthecauseoftheseveresituationinlaborsafetyliesmainlyinthegapsandconflictsoflegislating,theseriousweaknessofexecutingandespeciallysomeleadingcadresandproprietors,whodon’tattachimportancetolaborsafetyorputthesystemofjobresponsibilityregardingsafeproductionintoeffectandsomeworkerswhoareshortofsafetyawarenessandskills.Soappropriatemeasuresareprovidedinthethesis.Inaccordancewiththegeneralplanofrunningthecountrybytheruleoflaw,weshouldestablishacompletelegalsystemgoverningthelaborsafety,strengthentheexecutionsoastotrulycarryoutthemeasuresandfundamentallymakethesituationtakeafavorableturn.
