摘要：循環(huán)經濟是21世紀經濟發(fā)展最先進的模式，它從根本上緩解和消除了環(huán)境與發(fā)展之間的矛盾，緩解人類社會的資源矛盾，實現(xiàn)經濟活動的生態(tài)化轉向。世界上先進國家早在上世紀就開始對循環(huán)經濟進行立法，并通過長期的實踐，制訂了一整套較為完善的循環(huán)經濟法律體系。我國與發(fā)達國家相比，循環(huán)經濟發(fā)展較為落后，目前還處在源頭防污的清潔生產階段，在法律體系上，只頒布施行了《清潔生產促進法》，而且該部法律條文內容較為原則，無實施細則。我國建筑業(yè)在循環(huán)經濟方向還處于從末端治理向源頭防治的過渡階段，我國建筑業(yè)的現(xiàn)狀按清潔生產的要求還存在較多不完善，對人類健康和環(huán)境污染的現(xiàn)象也尚未完全得到有效控制，故在我國建筑業(yè)大力促進清潔生產是十分緊迫且十分重要的。結合發(fā)達國家循環(huán)經濟的立法和模式的成功經驗，對我國建筑業(yè)促進清潔生產，發(fā)展循環(huán)經濟提出了制訂《建筑業(yè)清潔生產促進法》，制訂和調整建筑業(yè)有關規(guī)范和標準，根據(jù)清潔生產要求修改《建筑法》，制訂相關的規(guī)章制度等法律建議，使我國建筑業(yè)真正做到清潔生產，快速實現(xiàn)循環(huán)經濟。

Abstract:Circulationeconomyisthemostadvancedeconomicdevelopmentmodelinthe21#century.Italleviatesandeliminatesthecontradictoryrelationshipbetweenenvironmentanddevelopment,alleviatingthescarcenessofresourcesinhumansociety,andachievingecologicaltransitionofeconomicactivities.Developedcountriesbegantolegislateforcirculationeconomyfromlastcentury,andhaveestablishedaperfectlegalsystemforitthroughlong-paredwiththecirculationeconomyindevelopedcountries,thecurrentsituationinChinaislessadvanced,andisstillatthestageofcleanproduction,whichonlyfunctionsasinitialprevention.Fromtheperspectiveoflegalsystem,ChinesegovernmentjustenactedtheLawofAdvancingCleanProduction,whichonlycontainsprincipledarticlesinsteadofdetailedaccountsforexecution.Fromtheviewpointofcirculationeconomy,constructionindustryinChinahasnotsurpassedthelevel,onwhichthefinalregulationoradministrationistransitingtowardstheinitialprevention.InaccordancewiththeLaw,thecurrentsituationofconstructionindustryinChinahasnotfulfilledthelegalrequirementsfully,andthephenomenaofhumanhealthandenvironmentalpollutionhavenotbeenundercontrolcompletelyyet,biningthesuccessfulexperiencesoflegislationandmodelsofcirculationeconomyindevelopedcountriesandthecurrentsituationsinChina,thisresearchproposestoestablishtheLawofAdvancingCleanProductioninConstructionIndustry,tosetupandadjuststandardsinconstructionindustry,toamendtheLawofConstruction,andtoestablishrelevantregulationsandpolicies,inordertoachievecleanproductioninconstructionindustryandacceleratetherealizationofcirculationeconomyinChina.
